These Terms of Service ("Terms") are a binding agreement between you and Dr. Sim Bhatti / ForgeIQ ("we," "us," or "the Company") governing your access to and use of this website, application, and any digital products, e-books, programs, or content offered through it (collectively, the "Service").

By creating an account, checking the box to accept these Terms, purchasing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and the Refund Policy. If you do not agree, do not create an account or use the Service.

All content, e-books, programs, and materials offered through the Service are provided for general educational and informational purposes only. They are not medical, nutritional, psychological, or healthcare advice, and they are not a substitute for professional medical judgment, diagnosis, or treatment.

The Service does not create a doctor–patient, provider–patient, or any other professional or fiduciary relationship between you and Dr. Sim Bhatti or any contributor, regardless of Dr. Bhatti’s status as a licensed physician. No physician–patient relationship is formed by your use of the Service, your purchase of any product, or any communication you may have with us.

The information provided is general in nature and may not be appropriate for you. It is not individualized to your medical history, conditions, medications, or circumstances.

You expressly acknowledge and agree that you will NOT use the Service, or any information within it, as a replacement for, or to delay or forgo, professional medical supervision, consultation, evaluation, diagnosis, treatment, or oversight from a qualified healthcare provider.

You agree to consult your primary care physician or another qualified healthcare provider before beginning, changing, or stopping any exercise, nutrition, supplementation, or health-related program, and to seek the advice of your provider with any questions about a medical condition, symptom, medication, or treatment.

Never disregard, avoid, or delay obtaining professional medical advice because of anything you have read or accessed through the Service. If you think you may have a medical emergency, call your doctor or emergency services immediately.

Physical exercise, dietary change, and other activities described in the Service carry inherent risks, including risk of injury or, in rare cases, serious harm. By using the Service you voluntarily assume all such risks and accept full responsibility for your own health, safety, and choices.

Individual results vary. We make no representation, promise, warranty, or guarantee of any specific result, outcome, or level of progress. Nothing in the Service should be interpreted as a promise or guarantee regarding health, fitness, body composition, or any other outcome.

You represent that you are at least 18 years old, that you are physically able to participate in exercise and nutrition activities, and that you have obtained any medical clearance appropriate for your circumstances — including if you are pregnant or breastfeeding, have or suspect any medical condition, or take prescription medication.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. We may suspend or terminate accounts that violate these Terms.

Upon purchase, you are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and view the purchased digital content for your own personal, non-commercial use through the Service.

All content is the intellectual property of Dr. Sim Bhatti / ForgeIQ and is protected by copyright and other laws. You may not download (except as expressly enabled), copy, reproduce, distribute, resell, publicly display, share your account or access, screenshot for redistribution, or create derivative works from the content, in whole or in part, without prior written permission.

To protect this content, delivered material may be individually watermarked and access is tied to your account. Unauthorized sharing or reproduction is a breach of these Terms and may result in termination of access without refund and further legal remedies.

Prices are listed in U.S. dollars. Payments are processed by our third-party payment processor (Stripe); by purchasing you also agree to their terms. We are not responsible for errors by the payment processor.

All sales are final. Because products are digital and delivered instantly, all purchases are non-refundable, as described in our Refund Policy, which is incorporated into these Terms by reference.

The community is a paid membership offered on a recurring subscription basis (currently $35 per month, plus any applicable tax). By subscribing, you authorize us and our payment processor (Stripe) to charge your payment method the then-current membership fee automatically at the start of each billing period until you cancel. Your membership renews automatically each period unless canceled.

You may cancel at any time through the billing portal (accessible from your account or the community) or by contacting support@simbhattimd.com. Cancellation stops future renewals; your access continues through the end of the billing period you have already paid for. Except where required by law, membership fees and any per-question fees are non-refundable, and we do not provide partial-period or pro-rated refunds. We may change membership pricing or features prospectively; we will provide notice of a price change, and your continued membership after it takes effect constitutes acceptance.

Expedited questions. You may optionally pay a one-time fee (currently $5) to prioritize a question in the queue. This fee purchases queue priority only. It is NOT a guarantee of a response, a specific or minimum response time, a particular format or length of answer, or any outcome. Questions submitted without the expedited fee are addressed on a best-effort basis with no guaranteed turnaround, and we do not promise that any given question will be answered.

Educational answers only — no medical advice, no doctor–patient relationship. Any responses provided in the community, including written notes and any linked or embedded video, are general educational information only. They are not personal medical, nutritional, psychological, or healthcare advice; they are not individualized to your medical history, conditions, medications, or circumstances; and they do not create a doctor–patient, provider–patient, or any other professional or fiduciary relationship between you and Dr. Sim Bhatti, regardless of Dr. Bhatti’s status as a licensed physician. Sections 2 and 3 of these Terms apply in full to all community content.

What not to submit. The community is not for medical emergencies, urgent concerns, or the diagnosis or management of your personal medical condition. Do not use it to seek individualized treatment decisions, and do not submit protected health information, sensitive personal details, or anything you would not want handled as general, non-confidential correspondence. Questions and answers are not confidential and are not protected by any physician–patient privilege. If you have a personal medical question or a possible emergency, contact your own physician or emergency services — do not wait for a community response.

Moderation and your submissions. We may decline, reject, edit, remove, or decline to answer any question at our discretion, including questions that seek personal medical management, are out of scope, or violate these Terms; a per-question expedited fee, if paid, remains non-refundable. By submitting a question, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, store, respond to, adapt, publish, and display your question and our answer within the Service. We use a hybrid visibility model: at our discretion, an answer may be published to the member library (visible to other members) or kept private to you. Because an answer may be shared with other members, do not include identifying or private details you are not comfortable being seen by others.

The Service and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any information is complete, current, or accurate.

To the fullest extent permitted by law, in no event will Dr. Sim Bhatti, ForgeIQ, or any of their affiliates, contributors, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, goodwill, health outcomes, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service or any content, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid to us for the product giving rise to the claim in the twelve (12) months preceding the event.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

You agree to indemnify and hold harmless Dr. Sim Bhatti, ForgeIQ, and their affiliates, contributors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We collect and process the information you provide (such as your name and email) and purchase records to operate the Service. We do not sell your personal information. Email communications are handled by our email provider, and payments by our payment processor, each under their own privacy practices.

We may modify or discontinue any part of the Service at any time. We may update these Terms from time to time; material changes will be reflected by a new effective date and, where appropriate, a renewed request for your acceptance. Your continued use after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought and resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction and venue of those courts, unless otherwise required by applicable law.
